Our Chief Justice must have been intentionally appointed by the Republican President, Mr. Hichilema, to work against the Constitution of the Republic of Zambia on gay rights.
Lusaka, Sept. 28 – Information circulating on social media point to an undeniable fact that we have in power a government that has intentionally been installed to rape the Constitution of the Republic of Zambia on critical issues of Zambia being a Christian Nation.

Pieces of information reaching us have revealed that the International Lesbian, Gay, Bisexual, Trans and Intersex Association – ILGA World and the International Service for Human Rights (ISHR) have compiled a list of independent human rights experts to monitor and report on human rights violations of the LGBTQ community.
Our Chief Justice, Mumba Malila, as part of this group, is reported to have undertaken to defend the human rights of lesbian, gay, bisexual, trans and intersex (LGBTI) persons against the prescriptions of the Constitution of the Republic of Zambia he swore to defend.
The fact sheets compile the references and recommendations made by these experts to LGBTI persons, sexual orientation, gender identity, gender expression, and sex characteristics (SOGIESC).
One of the said fact sheets, in relation to Zambia, is the controversial conviction and sentencing of Mr. Japhet Chataba and Mr. Steven Sambo to 15 years’ imprisonment for allegedly engaging in what Mr. Mumba Malila’s group terms as consensual same-sex relations, in violation of their right to privacy and non- discrimination, and their right to health and freedom from torture and cruel, inhuman and degrading treatment or punishment.
The Working Group of Experts on Arbitrary Detention is composed of five independent experts appointed by the Human Rights Council. All members serve in their personal capacities. A mandate-holder’s tenure is limited to a maximum of six years.
The Working Group holds three sessions per year, usually in April, August and November, each lasting between five to ten working days. At the end of its April session every year, the members of the Working Group elect their Bureau, comprised of the Chair-Rapporteur, Vice-Chair on Communications and Vice-Chair on Follow-up.

◾Ms. Priya Gopalan (Malaysia), appointed in 2021 – Chair – Rapporteur.
◾Dr. Matthew Gillett (New Zealand), appointed in 2022 – Vice – Chair on Communications.
◾Dr. Ganna Yudkivska (Ukraine), appointed in 2022 – Vice – Chair on Follow-Up.
◾Dr. Miriam Estrada-Castillo (Ecuador), appointed in 2020.
◾Mr. Mumba Malila (Zambia), appointed in 2020.
About 10 human rights lawyers have backed Chief Justice Mumba Malila’s call to respect the right of Homosexuals in Zambia.
The lawyers say homosexuals are entitled to all rights provided in the Constitution which include freedoms of expression, assembly, and association, privacy, equality and dignity.
The lawyers are of the view that fundamental freedoms should be enjoyed by all people, grounded on the principle of equality and non-discrimination, and elevated above the capricious whims of the majority.
But the big question remains. Does the Constitution of the Republic of Zambia recognise the LGBTQI community? And what is Mr. Hichilema and his government doing to defend the Constitution?
