Mwenye & Mwitwa – Advocates write Heartson Mabeta demanding that he retracts the defamatory statement within 24hrs failure to which their client would seek redress in the Courts of Law.

Lusaka, July 22 – In an apparent attempt to distract the public from serious corruption allegations made by former ACC Board Chairperson Musa Mwenye, SC, UPND member and Kankoyo MP Heartson Mabeta resorted to Ad Hominem attacks, posting a potentially defamatory statement on his Facebook page.

Mabeta accused Mr. Musa Mwenye, SC of pressuring the High Court to issue a US$33 million compensation ruling against KCM in favour of Copperbelt Energy, purportedly to secure a US$3 million commission by intimidating High Court Judge Justice Charles Kafunda. These allegations have been categorically denied by Mwenye & Mwitwa – Advocates.
“I just hope Uncle Musa will one day be able to also talk about how I defeated him over him demanding for the High Court to tell KCM to pay Copperbelt Energy 33 million dollars so that he could also get 3 million dollars commission for intimidating High Court Judge Charles Kafunda hence collapsing the out of court agreement between KCM and all its creditors when he was still the ACC Board Chairman,” Heartson Mabeta’s post read.
In a letter released to The Digest, Mwenye & Mwitwa – Advocates have demanded that Heartson Mabeta retract his defamatory statement and issue an apology within 24 hours. Failure to comply will result in Mr. Musa Mwenye, SC, seeking legal recourse.
“These allegations are baseless and malicious, especially given our client’s unblemished 25-year legal career without any sanctions from the Law Association of Zambia,” the letter states. “We demand an immediate retraction and apology in terms acceptable to our client within 24 hours, or our client will pursue legal action.”

Heartson Mabeta expressed embarrassment over Mr. Musa Mwenye’s decision to expose the unprecedented corruption within the UPND government. Senior public officials, including President Hichilema, have largely avoided asset declarations, which suggests significant corruption.

Three key points that the State Counsel brought out that shook Mabeta were:
◾Nearly three years have passed, and we should have witnessed the arrest and dismissal of certain government officials. This issue consistently caused friction between the Board and those who shirked their duties, choosing instead to selectively fulfill their responsibilities.
◾Despite being marginalized and denied access to information on ongoing investigations and prosecutions for an entire year, the Board persistently pressured the Director General and his team to act appropriately. I firmly believe that we cannot combat corruption unless we address all corruption—past, present, and future.
◾All public servants must demonstrate transparency in their financial dealings and be prepared to declare their assets and explain their acquisitions.
Who in their right mind could fault Mr. Musa Mwenye, SC, for making these crucial points and backing them up convincingly? Meanwhile, this very UPND loyalist is busy defending Sylvia Masebo, whose stint at the Ministry of Health was more about causing death through rampant corruption, leaving public health institutions high and dry without essential medicines for months on end.
